Terms of Sale

Article 1 – Company Information

FAMAYA is a sole trader (auto-entrepreneur) registered under SIRET number 991 172 875 00015, with its registered address at 18 rue du Commandant Abadie, 76600 Le Havre, France. Contact: famayacreation@gmail.com

Article 2 – Products

FAMAYA sells women's clothing and accessories through its online store. Product descriptions and photos are as accurate as possible. In the event of an error or omission, FAMAYA's liability shall not be engaged.

Article 3 – Prices

All prices are displayed in euros (€) inclusive of all taxes (TTC). FAMAYA is not subject to VAT pursuant to Article 293 B of the French Tax Code. Prices do not include shipping costs, which are indicated at checkout.

Article 4 – Orders

By placing an order, the customer confirms they are of legal age and accept these terms of sale in full. FAMAYA reserves the right to cancel any order in the event of a payment issue or suspected fraud.

Article 5 – Payment

Payment is due in full at the time of ordering. All transactions are secured via Shopify's payment system.

Article 6 – Shipping

Orders are processed and shipped within 48 business hours. Delivery is made via Mondial Relay or Colissimo within 5 business days. Shipping is free in France for orders of 120€ or more. A flat shipping fee applies for European destinations (Belgium, Netherlands, Germany, Luxembourg, and others).

Article 7 – Right of Withdrawal

In accordance with French consumer law (Article L.221-18 of the Consumer Code), the customer has the right to withdraw from their purchase within 14 days of receiving their order, without providing any reason.

Article 8 – Returns & Refunds

FAMAYA accepts returns within 30 days of receipt of the parcel. To initiate a return, the customer must contact famayacreation@gmail.com before sending the item back. Return shipping costs are the responsibility of the buyer. Items must be returned in their original condition, unworn and unwashed, with a tracked shipping method. Upon receipt and inspection of the returned item, a full refund will be issued to the original payment method within 14 days.

Article 9 – Intellectual Property

All content on the FAMAYA website is the exclusive property of FAMAYA and is protected by intellectual property laws. Any reproduction without prior written consent is strictly prohibited.

Article 10 – Personal Data

Customer data is collected and processed solely for order management and customer relations purposes, in compliance with the GDPR. Customers may exercise their rights by contacting: famayacreation@gmail.com

Article 11 – Applicable Law

These terms of sale are governed by French law. In the event of a dispute, an amicable resolution will be sought before any legal proceedings. The customer may also use the EU online dispute resolution platform: https://ec.europa.eu/consumers/odr
